General Terms & Conditions

1. Scope

For all orders placed through our online store by consumers and businesses, the following terms and conditions apply.

A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor part of their independent professional activity. Entrepreneur is a natural or legal person or a legally capable partnership with legal personality who, when entering into a legal transaction, is acting in the exercise of their commercial or independent professional activity

These terms and conditions also apply to future business relationships with entrepreneurs, without the need for us to refer to them again. “If the entrepreneur uses conflicting or supplementary general terms and conditions, their validity is hereby rejected; they will only become part of the contract if we have expressly agreed to them.

2. Contracting Parties, Conclusion of Contract

The purchase contract is concluded with MBzwo GmbH.

The presentation of products in the online store does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in the shopping cart without obligation and correct your entries before submitting your binding order at any time by using the correction aids provided and explained in the order process. By clicking the order button, you place a binding order for the goods contained in the shopping cart. The confirmation of receipt of your order is sent by email immediately after submitting the order.

The formation of the contract with us depends on the payment method you select:

Bank transfer prepayment with 3 % discount
We accept your order by sending a separate email confirmation of acceptance within two days, in which we provide you with our bank details.

Credit Card (Stripe):
Payment by credit card is a service provided by Stripe. By placing the order, you simultaneously transmit your credit card data to Stripe. After your verification as the legitimate cardholder, Stripe requests your credit card company to initiate the payment transaction, thus accepting your offer.

PayPal
During the order process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing the order in the shop, we request PayPal to initiate the payment transaction and thereby accept your offer.

Giropay (Stripe)
Paying with Giropay is a service provided by Stripe. After placing the order, you will be redirected to your bank’s website, where you can confirm the payment instruction with your bank. This is how the contract with us is concluded.

Klarna
When paying via Klarna, you will be redirected to Klarna CheckOut. There you can choose your payment method. The contract is concluded upon receipt of payment by Klarna.

Apple Pay
When paying via Apple Pay, the amount will be debited from your credit card that is saved at Apple. The contract is concluded upon receipt of payment.

3. Language of the contract, Storage of the contract text

The language available for the conclusion of the contract is German.
We save the text of the contract and send you the order data and our terms and conditions by e-mail. You can view the text of the contract in our customer login.

4. Delivery Conditions

We deliver free of charge to the kerbside within Germany. Premium shipping can be booked as an option, which includes delivery to the point of use and return of the packaging.

It is possible to collect the goods from the workshop yourself.

We do not deliver to packing stations.

IMPORTANT: Please ensure that the access routes are sufficiently dimensioned and accessible, especially when delivering larger table tops to the place of use. If the delivery cannot be realized due to insufficient access routes, you shall bear the costs for all further delivery attempts.

5. Payment

In our shop you can use the following payment methods:

Bank transfer Prepayment with 3% discount
If you select prepayment by bank transfer in the order process, you will receive our account details and can pay the amount by bank transfer.

For payments in advance we grant 3% discount. The settlement takes place in the ordering process after selecting the payment method.

In the case of table tops, receipt of payment also marks the start of planning and production. Shipping will take place within 6 to 8 weeks after receipt of payment. Items in stock will be shipped immediately after receipt of payment.

PayPal
During the order process, you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimize with your access data and confirm the payment instruction to us. After submitting the order in the store, we request PayPal to initiate the payment transaction.
The payment transaction is carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.

Credit Card (Stripe):
Payment by credit card is a service provided by Stripe. By placing the order, you simultaneously transmit your credit card data to Stripe. After your legitimation as a legitimate cardholder, Stripe will request your credit card company to initiate the payment transaction. The payment transaction is carried out automatically by the credit card company and your card is charged.

Giropay
After submitting the order, you will be redirected to your bank’s website. In order to pay the invoice amount via Giropay, you must have an online banking account with PIN/TAN procedure that has been activated for participation in Giropay, identify yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction will be carried out immediately afterwards and your account will be debited.

Klarna
Our online store offers the option of processing payments via Klarna as a payment service provider. Klarna is a service of Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden (hereinafter referred to as “Klarna”). Klarna offers various payment options that enable our customers to make purchases conveniently and securely.

By using Klarna as a payment method, you agree to Klarna’s General Terms and Conditions (https://www.klarna.com/uk/terms-and-conditions/). Please note that payment processing via Klarna and any fees or costs that may be incurred in connection with this payment method will be settled directly between you and Klarna. Our online store accepts no liability for any losses, damages or problems in connection with the use of Klarna as a payment service provider.

Cash payment upon collection
You pay the invoice amount in cash at the time of collection.

6. Retention of Title

The goods remain our property until full payment.
For entrepreneurs, the following shall apply in addition: We shall retain title to the goods until all claims arising from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you assign to us in advance all claims arising from this resale – irrespective of any combination or mixing of the reserved goods with a new item – in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the receivables, but we may also collect receivables ourselves if you fail to meet your payment obligations.

7. Transportation Damages

If goods are delivered with obvious transport damage, please complain about such defects to the delivery person as soon as possible and contact us immediately. Failure to make a complaint or contact us will have no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you assist us in asserting our own claims against the carrier or transport insurance.

8. Warranty and Guarantees

The statutory liability for defects shall apply. Information on any additional warranties that may apply and their exact terms can be found with the product and on special information pages in the online store.

9. Liability

For claims based on damages caused by us, our legal representatives or vicarious agents, we shall always be liable without limitation

  • in case of injury to life, body or health,
  • in the event of intentional or grossly negligent breach of duty,
  • in the case of warranty promises, if agreed, or
  • insofar as the scope of application of the Product Liability Act is opened.

In case of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner can regularly rely (cardinal obligations), liability for slight negligence on our part, our legal representatives, or agents is limited in terms of amount to the foreseeable damage that was typically expected to occur at the time of contract conclusion. Otherwise, claims for damages are excluded.

11. Dispute Resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here https://ec.europa.eu/consumers/odr/.
We are willing to participate in an out-of-court arbitration procedure before a consumer arbitration board.
The General Consumer Arbitration Board of the Zentrum für Schlichtung e.V., Strassburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de, is responsible.

Right of withdrawal

  • There is no right of withdrawal for custom-made goods.
  • Right of withdrawal within 14 days from receipt of the goods.
  • Revocation possible without giving reasons.
  • Notification of the seller about the revocation.
  • Refund of all payments, including delivery costs, within 14 days.
  • Duty to return the goods within 14 days after revocation.
